I want to apply AP for my daughter without lawyer's help. I didn't apply for her when I applied my 485 and AP but her 485 has been applied and I have the RN. Is it straightforward process. Since I applied for 485 July 2nd can't file electronically and must use old fee?.
Also in the application instructions under intial evidence section it says
An explanation or other evidence showing thecircumstances that warrant issuance of anadvance parole document; or
What does this mean, do I have to write an explanation letter :confused:

Guys/Gals,
Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?
I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.
Thoughts ? Knowledges ?

He refiled again this time with proper documentation and additional support letters from senior exec from my company.

I am changing my job on H1B. I have I-140 approved with present company. What documents do I need to have to keep my old priority date? I have copy of I-140 approval notice. Do I need to have copy of labor certification as well?

Hello sdouglas,
That is a problem with Swift and not with your PC configuration. I'm not sure why it would freeze or lockup when importing files. My best advice would be for you to uninstall Swift 3D and re-install it again. The problem should usually be solved. If the problem appears, it could be an error external to that of Swift.
Try re-installing your graphics card drivers if re-installing Swift does not solve the problem. If all else fails, try asking Electric Rain for help. It could be a bug =)

Recently my I-140 petition for EB2 was denied on educational grounds . The employer opened an MTR/appeal.
Is it possible to re-file the I-140 petition in EB3 using the same labor certification, while the first I-140 is pending appeal at AAO.

I am in a very sticky situation, my labor is pending @ PBEC with priority date of Jan'2004, which is Non-RIR and filed under EB3 category, based on which I have been getting incremental extensions of H1B (I am already in my 9th year by now). At present I am in the process of changing my filing type to RIR from TR and I was hoping to change the category too from EB3 to EB2, but my employers did not support me since they cannot pay the prevailing wage. I know I can still switch jobs, provided I transfer my H1B (which is valid till Jan�2008) and the new company files my GC immediately, so my questions to fellow victims of PBEC is
� How can I retain my old priority date?,
� Does the job descriptions filed with old labor have to match with job descriptions filed in PERM?
� It will be very tough, since I have almost 12+ yrs of exp in the industry, but my present employer is taking advantage of my situation and he is paying me peanuts, just because he does not want to pay me more, they have filed the papers as EB3. So while filing labor under EB2, can I still maintain my old priority date.
Please guys/gals help me out, I am not sure what to do, since I have already spent almost 3K$ on my GC and If I will be stuck with my employer at such low salary after my labor & I140 gets approved because of the retrogression it will be disaster. Is postal address for e-Filed AP & EAD same, I have e-filed the EAD/AP renewal have 2 questions please respond.
1) The postal address for AP shows same as EAD renewal for e-Filed, is this correct.
2) The 2 photos is only for EAD renewal not AP, seems they will take a picture/fingerprint for AP by appointment.
Req docs, you will have to send (I-765/EAD)
1. a copy of of your I-765/EAD E-file receipt,
2. pending I-485 receipt,
3. two 2"x2" passport photograph,
4. copy of your previous EAD, both side
5. drivers license, both side
6. passport non-immigrant visa page
(even if its expired, it will serve as a federal issued photo ID).

I just got an RFE for I-485...they are asking about marriage certificate and birth certificate...when I applied for I-485, I sent marriage certificate and birth certificate ..why they are asking me again to send?
And can you tell me please what to do with the following.......Uscis sent me too an envelope where to put my documents for RFE.......but the docs dont fit in the small envelope...is it ok if I put my docs in a different and bigger envelope?
My PD is sept 2005 ROW.

So are these different from the finger prints that we take for EAD? For people who got their priority date current, do they ask for a separate finger prints again? Does anyone can shed some light on this?

yes, they are right. if you try to file GC now then they will calculate your stay period and ask you to leave the country immediately (they wont even wait for july 2011). I think it makes sense to go out of country asap for one full year, come back with new H1 and then start the GC process. Alternatively if ur spouse is working and is on valid status then convert to H4. you can start ur GC process on H4 too. Once labor is approved activate your H1 and file for 7th-8th year extension.
im not a lawyer but my experience with immigration gives me the knowledge to suggest you the above. in such critical time its always worth to contact an immigration lawyer and seek advice.
